("TallyUp") recognizes that its visitors, members, users, and others who use the website at www.TallyUp.com or any TallyUp service provided through a third-party website (collectively, the "TallyUp Services"), (collectively or individually you, your, "Users") value their privacy. This Privacy Policy provides important information about the use and disclosure of User information collected on the TallyUp Services. TallyUp provides this Privacy Policy to help you understand what information TallyUp collects and how that information will be used.

Personal Information


"Personal information," as used in this Privacy Policy, is information that specifically identifies an individual, such as an individual's name, address, telephone number, e-mail address, or credit card number. Personal information also includes information about an individual's activities, such as information about his or her activity on the TallyUp Service, and demographic information, such as date of birth, gender, geographic area, and preferences, when any of this information is linked to personal information that identifies that individual.

Aggregate information is information that we may collect about a group or category of products, services or customers that is not personally identifiable or from which individual identities are removed. Collection of Information


Collection of Information Provided by You: TallyUp collects personal information that Users provide, in a variety of ways through the TallyUp Service. For instance, when visitors to the TallyUp Service register for an account, create, answer, share, or embed a poll, leave comments, or otherwise communicate via the TallyUp Service, TallyUp collects the personal information that is provided.  TallyUp may collect personal information such as name, e-mail address, postal address, demographic information, profile information, and other types of personal information in these manners, including information that may be available to TallyUp when user logs in using account credentials from another service, such as Facebook or Twitter.


Cookies: Cookies are small text files containing a string of alphanumeric characters that are sent to your computer that uniquely identifies your browser. Cookies make web surfing easier by saving passwords, and preferences while you're at a website. When you use the TallyUp Service, we may send one or more cookies to your computer. Some cookies are temporary and will disappear after you close your browser, while others will stay on your computer. If you wish to remove cookies from your hard drive, follow your web browser help file directions. You can also reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the TallyUp Service may not function properly if the ability to accept cookies is disabled.


Traffic Data: When you use the TallyUp Service, the TallyUp servers automatically log certain information that your web browser sends whenever you visit any website. This information may include information such as your Internet Protocol ("IP") address, browser type, browser language, referring/exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser.


Tracking Usage Patterns: TallyUp tracks usage patterns and collects other non-personally-identifiable information about the use of the TallyUp Services. TallyUp may employ various tracking technology to track the online usage patterns of Users (in a way that does not collect or disclose personally-identifiable information).


Information from Other Sources: In the future, TallyUp may receive information about you, including personal information, from third parties, and may combine this information with other personal information maintained about you. If we do so, this Privacy Policy governs any combined information that is personally identifiable.


The Way TallyUp Uses Information

Personal information that you submit to us through the TallyUp Service, will be used by TallyUp to provide to you the features and functionality of the TallyUp Service; to operate, maintain, enhance, and improve the TallyUp Service; to prevent fraudulent use of the TallyUp Service; to tailor your user experience; to maintain a record of our dealings with you; and for other administrative purposes.

Any personal information, text or other content that you voluntarily provide in the course of your use of the TallyUp Service, including but not limited to, information you provide in member profile, in polls, in discussions or in comments, is publicly available and can be viewed and used by others. Your user name (but not your email address) is displayed to other Users in connection with the polls you create or respond to, and any messages or comments you post. Any information that you post on the TallyUp Service may be redistributed through the internet and may be viewed by the general public. WE URGE YOU TO USE CAUTION WHEN POSTING PERSONAL INFORMATION PUBLICLY THROUGH THE TALLYUP SERVICE. We may allow you to select privacy options that limit access to some types of personal information, but no security measures are impenetrable or perfect.  We also cannot control the actions of other users with whom you may choose to share personal information, whether you share it on the TallyUp Service or by other means (such as email or telephone).  Additionally, even after information posted on the TallyUp Service is removed, caching and archiving services may have saved that information, and other users or third parties may have copied or stored the information available on the TallyUp Service.  We cannot, and do not, warrant or guarantee that any personal information that you provide on and in connection with the TallyUp Service will not be accessed, viewed, or used by unauthorized persons.

We may use your email address or other personally identifiable information to send commercial and marketing messages, and market research related surveys and other offers to you. You will have an opportunity to opt-in or opt-out of any such programs .

We may use cookies, clear gifs, and log file information to: (a) to assist with your use of the TallyUp Service by "remembering" information so that you will not have to re-enter it during subsequent visits to the TallyUp Service; (b) provide customized, personalized content and information for you; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) track your entries, submissions and status.


When TallyUp Discloses Information

Except as otherwise disclosed in this Privacy Policy, TallyUp will not share your personal information with other, third-party companies for their commercial or marketing use without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out.

We may share non-personal information (such as traffic information and usage tracking information) with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and functionality on the TallyUp Service.

We may provide information, including personal information, to third-party service providers (e.g., payment processing and data storage and processing facilities) that assist us in our work. We limit the personal information provided to these service providers to that reasonably necessary for them to perform their functions.

TallyUp may allow other companies, called third-party ad servers or ad networks, to serve advertisements within the TallyUp Service. These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements and links that appear on the TallyUp Service. They automatically receive your IP address when this happens. They may also use other technologies (such as cookies or other tracking technologies) to measure the effectiveness of their advertisements and to personalize the advertising content you see. Please note that if you respond to any advertisements, the advertiser or ad-server may collect certain information about you.

We will release personal information if required to do so by law, or in the good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. Copyright Law) or respond to a court order, subpoena, or search warrant.

In addition, information about our users, including personal information, may be disclosed as part of any merger, acquisition, debt financing or sale of company assets, as well as in the event of an insolvency, bankruptcy or receivership in which personal information could be transferred to third parties as one of our business assets.

TallyUp uses commercially reasonable safeguards (physical, managerial, and technical) to preserve the integrity and security of your personal information. However, we cannot ensure or warrant the security of any information you transmit to TallyUp and you transmit any such information at your own risk. Once we receive your transmission of information, TallyUp makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. Childrens' Privacy

Protecting the privacy of young children is especially important. For that reason, TallyUp does not knowingly collect or maintain personally identifiable information or non-personally-identifiable information on the TallyUp Service from persons under 13 years of age, and no part of our website is directed to persons under 13. If you are under 13 years of age, then please do not use or access the TallyUp Service at any time or in any manner. If TallyUp learns that personally identifiable information of persons under 13 years of age has been collected on the TallyUp Service without verified parental consent, then TallyUp will take the appropriate steps to delete this information.


International Users

The TallyUp Service is hosted in the United States and is generally intended for and directed to Users in the United States.
